1. About OpenScouter

OpenScouter is a B2B accessibility testing platform that connects businesses with neurodivergent testers. These terms govern your use of the OpenScouter website, platform, and related services at openscouter.com.

2. Eligibility

You must be at least 18 years old to use OpenScouter. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must not share your account with others. Notify us immediately at hello@openscouter.com if you suspect unauthorised access.

4. Client Accounts

Clients commission accessibility testing studies through the platform. You agree not to contact testers directly outside of the platform. Test data and reports are owned by the commissioning organisation and subject to the data processing terms agreed during onboarding.

5. Tester Accounts

Testers participate in accessibility testing sessions and are compensated for completed work. By accepting a study, you agree to complete the session honestly and to the best of your ability. Payment is issued after session review and confirmation, at the rate advertised for the study.

6. Data Collection During Sessions

During testing sessions, the Latch browser extension captures interaction data, facial expression data, and voice data as described in our Privacy Policy. All data collection requires explicit consent under GDPR Article 9 and only occurs during active, consented testing sessions.

7. WhatsApp Communications

By connecting your WhatsApp number, you consent to receiving study offers, session links, and payment notifications via WhatsApp. You can disconnect your number at any time from your account settings.

8. Payments

Tester payments are processed via Stripe Connect. OpenScouter is not responsible for delays caused by Stripe or your bank. Payment amounts are specified per study and are non-negotiable once a study is accepted.

9. Prohibited Conduct

You agree not to:

• Provide false or misleading information during testing
• Attempt to manipulate test results or scores
• Access the platform using automated tools without permission
• Share test data, reports, or client URLs outside the platform
• Harass or contact other users outside of platform channels

10. Intellectual Property

All platform content, design, and code are owned by OpenScouter. Test reports are owned by the commissioning client. Testers retain no rights to the data collected during sessions beyond what is specified in the Privacy Policy.

11. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting hello@openscouter.com. Upon termination, your data will be handled in accordance with our Privacy Policy.

12. Limitation of Liability

OpenScouter is provided “as is”. We are not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount paid to or by you in the 12 months preceding the claim.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.
